Take Action

Security officers can act against non-compliant companies by joining our picket lines, across the country. The Private Security Sector Labour Union Against Non-Compliance platform is systematically investigating, exposing, and taking strong action against the security companies who do not comply with the National Bargaining Council for the Private Security Sector (NBCPSS) Main Collective Agreement (MCA). Likewise, help us identify non-compliant security companies so we can force them to fully comply with the MCA and the laws of the republic.

We will also appeal to the law enforcement agencies such as the Hawks to investigate and arrest the Directors of non-compliant companies. As workers, we are also aware of unscrupulous healthcare service providers and insurance companies enticing and bribing company Directors to dishonour the MCA for personal gain at the devastating expense to security officers. We are going to open criminal cases against all these offenders. Equally we exhort the Financial Sector Conduct Authority (FSCA), the Private Security Industry Regulatory Authority (PSiRA), NBCPSS and the Council for Medical Schemes (CMS) must continue to investigate more thoroughly the criminal activities of these unscrupulous companies and bring them to book.

Our Demands

Pay Back the Money

First and foremost, these non-compliant security companies must pay back all the money deducted from their workers with immediate effect. More than R7.5 million per month is being fraudulently deducted from the salaries of private security officers. These money has not been transferred to the appointed service provider to benefit the workers.

“We are estimating that at least 30,000 workers are affected, and this figure is only those who have come forward (to complain). There could be many more people affected, and we demand that our members be refunded for this theft of their hard-earned income,” National Coordinator of KAWU Khumbulani Moyo said.

More millions are deducted as provident fund but not passed over to the PSSPF leaving workers stranded when they discover money was channelled into the pockets of greedy company bosses instead of the provident fund.

Register Security Officers for Health Insurance

We demand that ALL security companies duly register ALL their security officers with the designated healthcare service provider, Affinity Health, to ensure that the workers receive their healthcare benefits, as per the Main Collective Agreement.

Register Security Officers for Provident Fund

We demand that ALL security companies duly register ALL their security officers with the Private Security Sector Provident Fund to ensure that the lives of these workers and their families are protected from the catastrophic effects of loss of income by benefiting from better retirement, disability, death and funeral benefits.

Terminate Contracts

We demand that ALL non-compliant companies who have government contracts give notice to the government that they will terminate their contracts with the government, with immediate effect, and will no longer bid for government tenders until they comply with the Main Collective Agreement and all the laws of the Republic. Government can’t allow its premises to be protected by companies who don’t comply with the rules and regulations of the country. Furthermore, these non-compliant companies must be published on the Government Gazette and the NBCPSS website to warn workers of their modus operandi. Equally, we call on the National Treasury to cancel all the contracts of these corrupt companies.

Arrest Directors

We appeal to the law enforcement agencies such as the Hawks to investigate and arrest and charge the Directors of these unscrupulous and non-compliant companies. The FCSA, PSIRA, NBCPSS and CMS must also  investigate more thoroughly the criminal activities of the unscrupulous companies that collude with the security companies to defraud workers and bring them to book. As workers we are resolute in our demands, and we are going to open criminal cases against all the offenders.

Partnership

We call on the National  Treasury to work with The NBCPSS to ensure compliance controls from organs of state that award businesses to security companies are in place. To this end, we demand that the Minister of Finance outline steps to make it a legal requirement for all government entities and/or departments that are currently and will in future procure security services to work with the NBCPSS. The National Treasury should make compliance to be a compulsory requirement for all the prospective bidders. Likewise, we demand that the inspectors at the NBCPSS meticulously investigate these issues and then enforce compliance.
